1. Acceptance of Terms
By creating an account on CloneGen.app ("CloneGen", "the Service", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
CloneGen is operated by Andrew Mann, Geesthachter Straße 6, 23556 Lübeck, Germany.
2. Age Requirement
You must be at least 18 years of age to register for or use CloneGen. By creating an account, you confirm that you are 18 years of age or older. We do not knowingly provide services to minors. If we become aware that a user is under 18, we reserve the right to immediately terminate the account.
3. Description of Service
CloneGen is an AI-powered SaaS platform that enables users to:
• Create AI identity models using uploaded reference photos or text-based character generation
• Generate images using those models via text prompts
• Generate short AI videos based on text prompts or identity recreation
• Manage a credit balance for generation tasks
4. Account Registration
To use the Service, you must register an account with a valid email address and password, or via Google OAuth. You are responsible for:
• Providing accurate and up-to-date registration information
• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
You must notify us immediately at info@clonegen.app if you suspect unauthorized use of your account.
5. Credits and Payments
CloneGen operates on a credit-based system. Credits are required to generate images and videos. Credits can be obtained through:
One-time credit packs:
• 200 credits — €24.00
• 500 credits — €60.00
• 1,000 credits — €120.00
Monthly subscription plans:
• Basic — 290 credits/month — €29.00/month
• Growth — 890 credits/month — €79.00/month
• Scale — 2,490 credits/month — €199.00/month
All prices are listed in EUR. Payments are processed by Stripe. We do not store or handle any payment card data directly.
6. Refund Policy
Credits and subscription plans are generally non-refundable once purchased, except as required by applicable law (including EU consumer rights regulations). If you believe a charge was made in error, please contact us at info@clonegen.app within 14 days of the transaction.
Subscriptions can be cancelled at any time via your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused subscription time.
7. Acceptable Use
You agree not to use CloneGen to:
• Upload, generate, or distribute content that is illegal under applicable law
• Create or distribute content that depicts real persons without their explicit consent
• Produce content that defames, harasses, or impersonates any individual
• Generate content involving minors in any sexual, explicit, or inappropriate context — this is strictly prohibited and may be reported to law enforcement
• Circumvent, disable, or interfere with security features of the Service
• Use automated tools, bots, or scripts to access or scrape the Service
• Upload malware, viruses, or any malicious code
• Attempt to reverse engineer, copy, or resell the Service
8. User-Generated Content
You retain ownership of photos and content you upload to CloneGen. By uploading content, you grant CloneGen a limited, non-exclusive, royalty-free license to process and store that content solely for the purpose of providing the Service.
You represent and warrant that:
• You own or have the right to use any content you upload
• Uploaded content does not violate the rights of any third party
• Uploaded reference photos of real persons are used with their consent
9. AI-Generated Content
AI-generated images and videos produced via CloneGen are owned by you, subject to these Terms and any applicable third-party licensing from our AI infrastructure providers (Replicate, fal.ai). CloneGen does not claim ownership of your generated outputs.
You are solely responsible for how you use, share, or distribute AI-generated content produced on the platform.
10. NSFW / Adult Content
CloneGen does not currently offer accessible NSFW or adult content features to users. Any future access to adult content features will require age verification and explicit identity verification, and will be subject to additional terms. Users attempting to circumvent this will have their accounts terminated.
11. Intellectual Property
All software, design, trademarks, and infrastructure of CloneGen are the property of Andrew Mann. You may not reproduce, duplicate, copy, sell, or exploit any part of the Service without our express written permission.
12. Termination
We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if you violate these Terms, engage in fraudulent activity, or cause harm to other users or the platform.
Upon termination, your right to access the Service ceases immediately. Any unused credits at the time of termination for cause are non-refundable.
13. Disclaimer of Warranties
CloneGen is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will meet your expectations or requirements.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Andrew Mann shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or in connection with your use of CloneGen.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. The place of jurisdiction is Lübeck, Germany, to the extent permitted by applicable law.
16. Consumer Dispute Resolution
In accordance with § 36 VSBG (Verbraucherstreitbeilegungsgesetz), we are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or a prominent notice on the website. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
